I Grew Up on a Ranch

When I was just 10 years old, my father made the life-altering decision to move our family from Pasadena, California to Santa Margarita, California. Although it was only a distance of about 200 miles, it felt like we were traveling from the “Big City” to the “Wild West.” We drove past Santa Barbara, skirted the Los Padres National Forest, zipped by Santa Maria, and arrived at our destination. To say the least, I was not impressed.

My father, a contractor, had the big idea of creating a place where his family and friends could congregate on holidays and reunions, while simultaneously generating income to service and maintain the property. What looked to me like a ranch that needed a lot of work eventually grew into what is now a thriving business, Seven Oaks Ranch.

As I grew up on that ranch, I learned to appreciate the serenity of country life, and the magic of doing nothing, just sitting and listening to nature. The area only has about 1200 residents, but I eventually met some great friends, most of whom were Native Americans, and I felt fortunate to be immersed in a culture so different from my own.

Where is Santa Margarita, California?

Santa Margarita is located on California’s central coast, just north of San Luis Obispo, and in the southern foothills of the Santa Lucia Mountains. The environment is clean and fresh, but the town easily mixes its rich historical narrative with modern-day luxuries. Within easy driving distance are beaches, bays, lakes, mountains and streams, as well as great wine and horse country. Even after traveling extensively, I still find this place to be one of my favorite places in the world.

The Long History of Santa Margarita

The roots of Santa Margarita are said to stretch as far back as 900 B.C. when Native Americans are first thought to have reached California’s central coast area. The first hints of European influence came with the arrival of Spanish explorers in the late 1700s. Using Native American labor, the Franciscan friars who came with these expeditions built several nearby missions including Mission San Luis Obispo de Tolosa (eight miles south of Santa Margarita), its submission Santa Margarita de Cortona, and Mission San Miguel Arcangel (27 miles north of Santa Margarita). In fact, the 600 mile El Camino Real trail, which originally linked the 21 California Spanish missions, now serves as the city’s main street.

In the early 1800s, the Mexican government offered 35 land grants in the San Luis Obispo County area to soldiers who had fought for Mexico in its War of Independence. This led to the early formation of some of the area’s largest ranches. California became part of the United States, the Gold Rush brought new settlers, and the signing of the Land Act of 1851 all caused great changes to the make-up of Santa Margarita. By the late 1800s the railroads established a temporary terminal in Santa Margarita, bringing in an even wider variety of people.

Since these early days, the town has seen many ups and downs, but has always managed to retain its small-town charm. It now prides itself on being a quiet family community that is rich in history and adventure. Even as a 10-year-old boy, it didn’t take me long to discover that life on a ranch can be a very good thing.

Life if Santa Margarita today is a combination of the old and the new. Visitors can spend the morning horseback riding and then go for a zip line adventure in the afternoon. It’s a unique corner of California that offers a quiet retreat and outdoor excitement.

How I Learned to Sleep Better

When I first started having sleep problems, I did some research and found a few surprising statistics:

Amount of Sleep Needed: The Centers for Disease Control and Prevention recommend the following amounts of sleep per night:
- 0–3 months: 14–17 hours
- 4–12 months: 12–16 hours per 24 hours (including naps)
- 1–2 years: 11–14 hours per 24 hours (including naps)
- 3–5 years: 10–13 hours per 24 hours (including naps)
- 6–12 years: 9–12 hours per 24 hours
- 13–18 years: 8–10 hours per 24 hours
- 18–60 years: 7 or more hours per night
- 61–64 years: 7–9 hours
- 65 years and older: 7–8 hours
Sleep Problems: The American Sleep Association (ASA) reports that 50-70 million adults in the United States have some type of sleep disorder.
Lack of Sleep Interrupts Our Lifestyles: 37.9% of the ASA survey respondents said they unintentionally fell asleep during the day at least once in the preceding month.
Lack of Sleep is Unsafe: 4.7% reported nodding off or falling asleep while driving at least once in the preceding month. Drowsy driving was found to be responsible for 1,550 fatalities and 40,000 nonfatal injuries annually in the United States.
Lack of Sleep Can Be Deadly: 100,000 deaths occur each year in American hospitals due to medical errors; sleep deprivation has been shown to make a significant contribution to these figures.

The sleep-challenged may not be alone, but that doesn’t make us feel any better. As children, we could fall asleep so easily – sometimes right at the dinner table! And, now, it is just such a nightly drama. Whether it’s due to stress, medical conditions, or poor sleep habits, more and more adults are sick and tired of being tired!

What are the benefits of a good night’s sleep?

Getting a good night’s sleep is one of the most important things you can do for your health. It gives your body time to repair itself. How I Improved the Quality of My Sleep

I researched a number of ways to improve my sleep, and here are some of the strategies I found:

Melatonin: Many people worry that it will make them feel sleepy the next day. However, a Consumer Reports survey found that only 5-10% of people said they feel sleepy the day after taking melatonin. When I first tried Melatonin, I saw only moderate improvements in my sleep quality. But it wasn’t until I started taking Melatonin with 5HTP and Rhodiola, that I began to see a big difference. This unique mixture of ingredients in one pill, significantly improved my sleep quality. Establish Healthy Sleep Patterns: The American Sleep Apnea Association recommends setting a specific pattern for going to bed. Some of our current nighttime habits actually work against sleep.
Cognitive Behavioral Therapy: CBT is a multi-component approach that aims to combat the maddening symptoms of insomnia. This therapy works to restructure or break down the cycle of frustrating thoughts by identifying and altering unconscious beliefs that contribute to insomnia. The Sleep Foundation reports that 70-80% of patients with primary insomnia improve after applying the CBT technique.
Mattress and Bedding: The 2012 Bedroom Poll reported that 93% of people said a comfortable mattress is important to being able to get quality sleep; 78% said they are more excited to go to bed if they have fresh-smelling sheets. My personal preference is Sleep Cycle. This app analyzes and tracks your sleep, and wakes you up at the perfect time feeling rested.

Case Studies About How to Improve Sleep Quality

Some interesting case studies about various methods to improve sleep include:

Exercise to Improve Sleep Quality: The findings suggest that exercise can improve sleep quality without notable adverse effects.
Wearable Solution from Philips: The SmartSleep tracker from Philips is a closed-loop, EEG-based system with two small sensors that detect periods of slow wave sleep and intervene with clinically proven customized audio tones to boost it in real time. 70% of users report feeling less tired during the day.
Sleep Positions: OnHealth found that sleeping on your side may be good for those who snore. It is also possible that sleeping on your side could help your brain clear out waste more quickly. Patients with GERD usually find it is best to sleep on their left side.

Mayo Clinic also has five suggestions to get better sleep. You have nothing to lose — only a bad night’s sleep, bags under your eyes, and one yawn after another during an important meeting. I don’t miss them, and neither will you!

Amazon Air Purifier Cured My Allergies

As a web strategist, much of my time is spent indoors building websites and tending to an avalanche of emails. Hence, the quality of the air matters big time for me.

I have always wanted to get an air purifer, but when I looked on Amazon, they all looked so friggin expensive, and I just couldn’t justify spending that much money on it.

As far as how it is in your room, it’s so quiet that you hardly even know that it is there. This is a purifier that is easy to use and can handle a room up to 1,300 square feet. Yes, a room that size. It is said to remove 99.9 percent of allergens and has additional options for removing smoke and other odors. If it matters to you, it comes in a wide range of colors to accommodate any decor.

Features of the Alen BreatheSmart

The product itself is approximately two feet high and weighs 27 pounds. You will find the air intake vents on the sides of the unit so that you can put it against any wall when it is in use, and even when it isn’t. It comes with wheels so that you can roll it where you need to, as it is fairly heavy.

On the front, you have a panel that is customizable to meet your needs so that you can tell the purifier how much you want it to clean today. The noise level is rated at an amazing 25 decibels which is comparable to a whisper. Even at its highest speed, you may hear your refrigerator more than this purifier. This noise level is referred to as pink noise, which will also help you to sleep better.

Energy-wise you are looking at a purifier that only consumes 45 watts. Yes, that means you have light bulbs that are more energy-costly. Even so, there are features that allow you to adjust the power modes to auto to save even more power. A timer is also added into this model, which allows you to set it and forget it, or have it turn on when you are cooking.

Another feature I loved included the intuitive interface. This had seven buttons that could easily be programmed. Turn it on or off with a single button, or put it on auto. On auto, it cycles through all five settings without you having to think about it.

Other buttons included are a child lock button, which helps if you have little ones around. They won’t be able to play with its pretty interface. The power switch is right in the center, with a circular indicator letting you know how clean the air is as it is in use. Blue means the air is clean or of excellent quality, purple is not a great color. You may even turn it on and realize that the air is already clean enough, or that it really needs a good clean based on this color.

As far as filters are concerned you have the true HEPA filter, the Fresh filter for extra absorption, and the pet and heavy filters for allergens, odors, and pathogens. You’re never going to be confused about whether this purifier is working.

To add to it, you have a lifetime warranty and excellent customer service. As intuitive as this purifier is, I still called the customer service line for help setting it up and understanding the filters and the call was quick and easy.

I love that this is a smart product in that this makes it all very easy to figure out. I can easily see why this is the purifier that everybody is raving about online.

Every purifier wants to be this one. This is why it is so expensive, not because it is popular, but because it is an excellent product. Not many will tell you in advance whether the room even needs to be purified or not.

It blends in any room, and it works very quietly. And it works amazing! I’ve already started to notice a difference in my energy levels. The air in my room smells like fresh outdoor air you would smell when you are camping in the wilderness.

Can I Sue Someone for Leaving a Bad Yelp Review?

For a small business, Yelp reviews can have a huge impact on your local reputation. In a world where everything is sociable and shareable, many people look to Yelp to find out information about the quality of small businesses in their neighborhood.

For those that have a bevy of positive reviews, this can build confidence among consumers and lead to an abundance of new sales. However, for a business that has bad reviews on Yelp, the results can be disastrous for their reputation.

When small business owners see that a person has left a negative review on Yelp, a variety of different emotions are likely going to run through their minds. Thoughts that range from “That person doesn’t know what they’re talking about” to “It must be one of my competitors trying to slander my company” — they are all likely.

As your blood starts to boil and you only get more angry, it’s also likely that you consider what sort of legal action you can take against the person who has left a negative review.

One of the first reactions is to take the reviewer to court and sue them for leaving a bad Yelp review.

Cases like this are popping up all over America, with mixed results for both business owners and reviewers. Here is a look into whether a business can sue someone for leaving a bad review on Yelp, and what is needed on behalf of each party to stay legally protected.

Reviewer Is Protected Under the First Amendment

It’s important to understand that, under the First Amendment, a customer does have the right to leave a review based on his or her experience at a particular business. The First Amendment protects citizens and allows them to speak freely, which can include both positive and negative experiences.

While the First Amendment does ensure free speech, it doesn’t prevent false or untruthful comments that hurt a company’s reputation. This means that the comments made by a reviewer on Yelp must be proven as truthful or honest, based off their experience with a particular business.

For example, in the Arizona case above, a woman went online to share her experience with a vehicle repair company. Kendra McConnell claimed that after leaving her Jeep with Premier Coach Works in El Mirage, they failed to do an adequate job of repairing her vehicle. In her review, she stated that the company failed to return phone calls, overcharged for services and did not properly repair the vehicle as promised.

This sort of situation can certainly be a challenge for both parties. For the consumers, they feel as if they’ve been cheated and have the right to leave a review based on their experience. But for Premier Coach Works, the company feels victimized by the impact that a negative Yelp review can have on its business.

Business Must Provide the Burden of Proof

In deciding whether a company can sue reviewers for their negative comments online, it comes down to the ability of that company to prove the statements made were untrue. For example, in the Premier Coach Works case, it was up to the company to prove that McConnell was not being factual in the comments she made.

As a consumer, knowing that you can be taken advantage of by a company can be a scary thought. Luckily, we now live in a time in which nearly everything can be recorded and used as justification for improper services. For example, a customer can use emails, text messages and legal tender to prove the commitments were not upheld by the company they used.

If the evidence proves that the comments on Yelp were factual and honest, there are no grounds for the reviewer to have to remove the post. In addition, the business cannot sue the reviewer for those comments.

While businesses may hear this and think they are now at the mercy of their customers, this isn’t necessarily the case. Just as consumers can use evidence to argue their reasoning for a negative review, the company can use the same information to defend the reputation of their business. In the event that the case moves to a courtroom, the same information can be used to persuade a judge to have the review on Yelp removed if the post is not truthful.

Both Parties Can Come to an Agreement

Yelp was created with the intention of being a platform on which consumers could state their insight and experiences with local businesses. The truth is that this helps to protect consumers, and it also holds businesses to a higher standard to ensure that they’re providing the best service possible to their customers.

Because of the damage that negative Yelp reviews can cause, however, there is now concern for customers making untruthful comments about their experiences at a given business.

In the case of McConnell and Premier Coach Works, the two sides came to an agreement outside of court. In many instances, this could be what ideally occurs for businesses and Yelp reviewers.

If you want to prevent the headache that comes from a negative Yelp review, there is a simple solution: Make sure you give great service to every customer who walks through the door. However, if you’ve done all you can and you still feel you’re receiving unjustified negative reviews on Yelp, it’s important to know that your business is protected.

Evidence is everything when it comes to these sorts of cases on Yelp. So whether you are a business or a customer, make sure you are prepared to defend yourself and the actions you take online.
